Today is the launch of the much anticipated Global Commission on HIV and the Law report on how law and human rights can transform the global AIDS response with evidence-informed solutions for protecting the health and human rights of people affected by HIV. Over the past year and a half, the NGO Delegation has been posting about and has been involved in the regional consultations that have provided evidence for the report’s research.

On Monday, 9 July 2012, the Global Commission on HIV and the Law, an independent body of leaders and experts convened by the United Nations Development Programme (UNDP) on behalf of the Joint United Nations Programme on HIV/AIDS (UNAIDS), will launch a landmark report exploring how law and human rights can transform the global AIDS response.

The Commission’s report is based on 2 years of extensive research, and first-hand accounts from more than 1,000 people in 140 countries. It focuses on some of the most challenging legal and human rights issues in the context of HIV, including criminalization of HIV transmission, drug use, sex work, same-sex sexual relations, and issues such as children’s rights, violence against women and access to treatment. The report includes vital evidence-informed solutions for protecting the health and human rights of people affected by HIV.

The Global Commission on HIV and the Law has launched the complete Regional Dialogue resources. They feature Regional Dialogues Reports, Issue Briefs, Press Releases, pictures and video.

“From February 2011 to September 2011, the Global Commission on HIV and the Law held seven regional dialogues -  in Asia and the Pacific, the Caribbean, Eastern Europe and Central Asia, Latin America, Arab States, Africa, and High Income Countries. Through these regional dialogues, the Commission gathered and generated compelling evidence illustrating how repressive laws, policies and practices, that do not respect human rights, hamper effective HIV responses and how enabling legal environments that promote and protect the human rights can achieve tremendous progress.

In Sub-Saharan Africa, the region most heavily affected by HIV, legal, policy and social barriers, including stigma, discrimination, gender inequality and the criminalization of key populations at higher risk of HIV infection, continue to make people vulnerable to HIV and hamper the ability of individuals, communities and states to respond to the epidemic. This was the conclusion of the Regional Dialogue for sub-Saharan Africa, part of the Global Commission on HIV and the Law, held at the beginning of August in Pretoria, South Africa.

The goals of the Global Commission on HIV and the Law dialogues have been to give voice to regional and country perspectives on issues of HIV and the law and to contribute to regional efforts for creating enabling legal environments which support effective HIV responses. At the forums, civil society, government officials, law experts, United Nations representatives and members of the Global Commission have discussed gaps and opportunities for changes in the law, practices of law enforcement, issues with legal aid and access to redress.

Global Commission on HIV and the Law: Asia-Pacific Regional Dialogue

The Asia-Pacific Regional Dialogue will take place on 16-17 February 2011 in Bangkok, Thailand. This and other regional dialogues will give voice to regional and country perspectives on issues of HIV and the law and aim to contribute to regional efforts for creating enabling legal environments that support effective HIV responses.

The Call for Submissions for this Regional Dialogue closed on 3 January. Over 130 submissions were received from throughout the region and in several languages, covering a range of issues from criminalization of transmission, MSM, sex work, drug use and transgender people to discrimination of people living with HIV, orphans and vulnerable children, women and treatment access. Activists, community workers, people living with HIV, members of key populations, researchers, lawyers and parliamentarians forums have all made submissions.
