Namibia’s High Court has ruled that the country’s government sterilized without their informed consent three HIV positive women as they gave birth in public hospitals, although the judge rejected the link to their HIV status.

In 2008, the International Community of Women living with HIV and Namibia Women’s Health Network documented many cases of forced sterilization of HIV positive women. With the support of the Legal Assistance Centre and Southern Africa Litigation Centre, in 2010, three women brought their case to court and challenged that this procedure violated their rights to life, privacy and freedom from cruel, inhuman and degrading treatment.

At the XIX International AIDS Conference on July 26th, the NGO Delegation officially launched the publication of the results from its 2011 Report to the UNAIDS Board. Delivered at the 29th meeting in December 2011, the report focuses on the importance of the legal environment to national HIV responses. For its findings, the NGO Delegation conducted a series of 27 focus groups, involving more than 240 participants from every region of the world.

Today is the launch of the much anticipated Global Commission on HIV and the Law report on how law and human rights can transform the global AIDS response with evidence-informed solutions for protecting the health and human rights of people affected by HIV. Over the past year and a half, the NGO Delegation has been posting about and has been involved in the regional consultations that have provided evidence for the report’s research.

Today is the thematic oncombination prevention at the PCB. Thematic days are meant to offer a forum to discuss salient toipcs related to HIV; in the subsequent PCB meeting after a thematic, recommendations and actions are offered to UNAIDS and its Board from the day’s findings and conclusions.

This year, the NGO Delegation report focuses on the importance of the legal environment to national HIV response. Last year, our report focused specifically on stigma and discrimination and its impact on the access to prevention and care services. This year, our report complements the information collected last year from more than 1000 respondents.

In 2011, we conducted a series of 27 focus groups in which approximately 250 participants from every region of the world participated, covering a broad range and diversity of people. All focus groups were developed with the same methodology ensuring a common result. The feedback and commitment all participants have shown is strong evidence of the need to share their experiences and also to bring solutions so that others avoid suffering similar violations and abuses.

The NGO Delegation presented its 2011 NGO Report on legal environments and HIV responses at the 29th UNAIDS Programme Coordinating Board meeting on 13 December 2011.

To support the presentation and its report, the NGO Delegation has produced a short video featuring interviews from people working in the HIV field and who have been affected by HIV. The video highlights the effects of laws and policies, both on a wide-scale and personally, and offers important recommendations for policy-makers.

Sean Strub, founder of POZ Magazine and Senior Advisor to rthe Positive Justice Project, has been an important supporter of the NGO Delegation during the development of this year’s NGO Report on legal environments and HIV responses.

“HIV Is Not A Crime” is Sean’s documentary film project about HIV criminalization.  This eight minute trailer from the film features moving interviews with Nick Rhoades, Robert Suttle and Monique Howell Moree, who were all prosecuted for failing to disclose their HIV positive status prior to sexual contact.

NGO Delegate Speaks to UNAIDS Member States on Legal Environments & HIV Responses

On 28 November 2011, NGO Delegate for Europe, Mat Southwell, presented an overview of the 2011 NGO Report at a UNAIDS Member States meeting in Geneva ahead of the Programme Coordinating Board gathering from 13-15 December. After the presentation, States had the opportunity to ask questions and discuss its findings.

The NGO Report focuses on the experiences of people in different policy and legal environments and how those affect local HIV responses. You can read the full report in seven languages on our special Report page. It will be officially presented to the Board at the upcoming meeting.

2010 NGO Delegation Consultation Results – Stigma and Discrimination: Hindering Effective HIV Responses

This is a summary report of the data received from 1556 participants in an online consultation carried out during March-April of 2010. The data here – supplemented by survey comments, more than 50 interviews and 8 focus groups – was presented to the UNAIDS Programme Coordinating Board (PCB) in June 2010 in the annual NGO Report.

Sara Simon and Natalie Siniora of the UNAIDS PCB NGO Delegation’s Communication Facility worked with Laurel Sprague, data analyst at Wayne State University, to develop this summary report and five regional reports. We want to sincerely thank the hundreds of you who participated in the electronic consultation, interviews and focus groups that made up a large basis of this report for your time and valuable information.

NGO Report Consultation Deadline MARCH 15

Each year, the NGO Delegation to the UNAIDS governing body (called the Programme Coordinating Board or PCB) submits a report to the Board. This is an important opportunity for us to present the unique perspectives of civil society on the developments and issues around the AIDS pandemic. Broad input from civil society informs the NGO report, particularly regarding key issues on the agenda, but also regarding persistent or emerging issues “on the ground.”

This year, we anticipate that the June 2010 board meeting will include agenda items such as non-discrimination; men who have sex with men (MSM); and a thematic focus on sexual and reproductive health services linked to HIV.

The survey is currently available in English, Spanish, French, Portuguese, Russian, Chinese, Burmese, Arabic, Thai and Swahili. Please take the time to complete the survey before the 15th of MARCH.
